attitude.

Lloyd's List
Johnny
Saadé to fight on for shares
April
18, 2007 Wednesday-
Johnny Saadé is to pursue his legal battle with
his brother Jacques over their respective ownership
rights in the CMA CGM shipping group, saying he is seeking
restitution of shares worth more than $2bn, writes Andrews
Spurrier in Paris.
Reacting
to a recent order from the Marseille Court of Commerce
ordering his company Mistral Holding to cease "denigrating"
CMA CGM, Johnny Saadé has challenged the legal
basis of judgment and accused Jacques Saadé of
"instrumentallising" CMA CGM to protect himself.
Mistral
claims in a statement that French law stipulates that
the offence of denigration can only apply to companies
which are in competition, which it says is not the case
of Mistral and CMA CGM.
It
adds that the allegations are not directed against CMA
CGM but against Jacques Saadé and his Lebanese
holding company, Merit, and offshore companies which
he says are depending on it.
It
says that the judgment of Marseilles Court of Commerce
does not alter the fact that Jacques Saadé is
the object of ongoing judicial proceedings in several
countries, including France.
In
Paris, Mistral is seeking to have annulled the peace
agreement struck between Jacques and Johnny and Jacques
Saadé in September 2000, claiming the evaluation
of the value of Mistral's 10% 2000, claiming the evaluation
of the value of Mistral's 10% holding in CMA CGM was
based on false information about the company's finances.
